Terms of sale
General terms for buying food and drinks through this website, under Italian Legislative Decrees 206/2005 (Consumer Code) and 70/2003 · Last updated 24 October 2026
This is a courtesy translation: the contract is concluded in Italian and, in case of discrepancy, the Italian version prevails.
Art. 1 – Seller, subject and language
These terms govern purchases made through this website between Umami Group S.r.l., VAT no. 03541490540, REA PG-296768, registered office Via Los Angeles 145, fraz. Santa Maria degli Angeli, 06081 Assisi (PG), Italy, PEC umamigroup@pec.it, e-mail info@umamibeer.it, phone 392 204 3500 (the “Seller”), and anyone placing an order (the “Customer”), whether a consumer or a business. The subject of the sale is the food and drinks on the Umami Beer menu, for collection at the restaurant (takeaway) or home delivery. The service is available in Italy only.
Art. 2 – Pre-contractual information
Before ordering, the Seller provides the information required by the Consumer Code: product features, allergens, prices including VAT, delivery costs, payment and delivery methods, together with these terms and the Privacy notice.
Art. 3 – How the contract is concluded
- To order, the Customer needs an account, registered with truthful data and a verified phone number.
- The Customer chooses products from the online menu, any options and variations, and whether to collect them or have them delivered, with the address and preferred time.
- Before sending, the site shows a summary with products, quantities, prices, delivery cost and total. By sending the order the Customer accepts these terms.
- The contract is concluded when the Seller confirms the order: the Customer receives the confirmation on screen and by e-mail, with the order summary, which should be kept.
- The Seller may decline an order, informing the Customer, for example if the service is suspended, the restaurant is closed, a product is unavailable or the address is outside the delivery area.
Art. 4 – Products, allergens and prices
- Each product is described on the online menu with name, description, price and allergens. Photos are for illustration only.
- Prices are in euro and include VAT. Paid options and variations show their price before being selected and are included in the summary.
- Gluten-free dishes are prepared with suitable ingredients; since the kitchen also handles gluten and other allergens, Customers with severe allergies or intolerances should say so in the notes and contact the restaurant before ordering.
- If an ordered product is unavailable, the Seller informs the Customer and agrees an alternative or removes it from the bill.
Art. 5 – Delivery costs
- The delivery cost depends on the road distance and travel time between the restaurant and the address, calculated automatically; the site shows it before the order is sent. Currently:
- up to 4 km (and 8 minutes’ drive): € 3.00
- up to 10 km (and 12 minutes’ drive): € 4.00
- up to 15 km (and 15 minutes’ drive): € 5.00
- beyond: € 6.00
- For takeaway orders a packaging charge may apply, shown in the summary.
- Customers collecting their order at the restaurant pay no delivery cost.
Art. 6 – Delivery area
Home deliveries are made within 50 km by road of the restaurant. The site checks the address and does not accept orders outside this area.
Art. 7 – Opening hours and delivery times
- Orders can be received during the restaurant’s opening hours:
- Monday: 18:30 - 24:00
- Tuesday: 18:30 - 24:00
- Wednesday: 18:30 - 24:00
- Thursday: 18:30 - 24:00
- Friday: 18:30 - 01:30
- Saturday: 18:30 - 01:30
- Sunday: 18:30 - 24:00
- The delivery or collection time chosen by the Customer is an estimate and may vary with traffic, weather and number of orders. The Seller informs the Customer of significant delays.
- The Seller is not liable for delays due to unforeseeable events or force majeure (natural disasters, strikes, road closures).
Art. 8 – Payment
Payment is made on delivery or collection, with one of the methods chosen in the order: cash, card (debit or credit card) or Satispay. No online payments are made on the site. Customers paying cash are asked to have the exact amount ready. Non-cash methods carry no extra charge.
Art. 9 – Delivery and transfer of risk
- Products are delivered in intact, food-safe packaging to the address given in the order, which cannot be changed after sending without the Seller’s agreement.
- The Customer or a person they designate must be at the address at the stated time and collect the goods without unreasonable waiting.
- The risk of loss or damage passes to the Customer when they physically receive the products (Art. 63 Consumer Code).
Art. 10 – Alcoholic drinks
Alcoholic drinks are sold to adults only. A Customer ordering them declares to be at least 18; on delivery or collection an identity document may be requested and, if the recipient is a minor or does not show it, alcoholic drinks are neither delivered nor charged.
Art. 11 – Storage
Dishes are meant to be eaten straight away. If not eaten immediately they must be refrigerated and eaten within 24 hours. Packaged products follow the manufacturer’s instructions and expiry dates. The Seller is not liable for damage caused by improper storage.
Art. 12 – Right of withdrawal
As the goods are food and drinks prepared to order and liable to deteriorate rapidly, the right of withdrawal is excluded under Art. 59(1)(c) and (d) of the Consumer Code. The Customer may still cancel an order by phoning the restaurant before preparation has started.
Art. 13 – Non-conforming products and complaints
If a product does not match the order or is not as described, the Customer reports it promptly, at the latest on the same day, on 392 204 3500 or at info@umamibeer.it: the Seller will replace or refund the product, at its choice. Complaints and suggestions are answered within 5 working days. Statutory consumer guarantees remain unaffected.
Art. 14 – Customer obligations
The Customer undertakes to provide truthful data, keep their credentials safe, read product details and allergens, and not let children under 14, or people unable to assess allergens, place orders on their own. In case of uncollected orders or repeated misconduct the Seller may suspend access to the service.
Art. 15 – Personal data
Customer data is processed under Regulation (EU) 2016/679, as described in the Privacy notice.
Art. 16 – Intellectual property
Texts, images, logos, graphics and software on the site belong to Umami Group S.r.l. or their respective owners and are protected by law. The Customer may use the site for personal use only; copying or extracting its content, including with automated tools, requires written permission.
Art. 17 – Governing law and jurisdiction
The contract is governed by Italian law. Disputes with a consumer fall under the court of the consumer’s place of residence or domicile; otherwise the court of Perugia. Consumers may also use the alternative dispute resolution procedures under Articles 141 et seq. of the Consumer Code.
Art. 18 – Changes
The Seller may update these terms; each order is governed by the terms published when it is sent.
